StayAltered is a worldwide community ensuring global tourism benefits local communities. When you join The StayAltered Hosts Collective, you gain access to a worldwide network of independent hosts like you and an ecosystem of solutions that help you grow revenue from guests who stay longer, spend more, and support local communities.

This membership agreement (the “Agreement”) is by and between StayAltered (the “Company”) and the undersigned host (the “Host”) (collectively the “Parties”), effective as of the date set forth below (the “Effective Date”).

Collaboration & Consent

1. Both Parties agree to work in good faith with each other, and to treat the Guests, Hosts, Contributors and other members of The StayAltered Community with kindness and respect without discrimination or harassment.
2. Both Parties consent to the other Party promoting either Party’s services and brand.
3. The Host agrees to provide sufficient information about the Place, which may include descriptions, photos, videos, and other necessary information for StayAltered to create the Place Listing.
4. The Host warrants that it owns all information and media shared with StayAltered, and StayAltered has permission to reproduce and broadcast such information and media.
5. StayAltered agrees to work with the Host and to reasonably promote the Place on its Platform.

Time & Cancellation

1. This Agreement will be for a period of one (1) year from the Effective Date and may be extended by mutual agreement of the Parties.
2. Either Party may terminate this Agreement at any time for any reason with at least seven (7) days written notice to the other Party.
3. StayAltered reserves the right to immediately terminate this Agreement for any inappropriate Host conduct, to be reasonably determined in good faith.

Minimum Licenses, Insurance & Compliance with Laws

1. The Host agrees and warrants that at all times relevant to this Agreement, it possesses and will maintain all necessary minimum business permits, licenses, and liability and/or property insurance to legally and safely operate its Place(s).
2. The Host agrees and warrants that at all times relevant to this Agreement, it has complied with all relevant laws to legally and safely operate its Place(s).

Dispute Resolution

1. Alternative Dispute Resolution (“ADR”) means informal methods of resolving disputes (example: mediation or binding arbitration).
2. Prior to filing any formal lawsuits, the Parties both agree to first attempt to informally resolve any and all disputes first, and if unsuccessful, to try any form of ADR.
3. The Parties hereby agree to engage in good faith throughout all ADR attempts.
4. If the Parties agree to mediation or binding arbitration, the Parties will select a mutually agreed-upon ADR administrator and reasonably share in all associated ADR fees and costs.
5. In the event a Party elects to file a formal lawsuit against the other without first attempting to resolve the dispute in good faith via ADR, the filing Party will not be entitled to an award of reasonable attorneys’ fees and costs.
6. However, in the event both Parties have already attempted good faith ADR and are still unable to reach an agreement, either Party may file a formal lawsuit, and the prevailing party is entitled to an award of reasonable attorneys’ fees and costs.
7. This Agreement shall be governed by and construed in accordance with the laws of California, United States, and StayAltered and the Host agrees to submit to the personal jurisdiction of California and a California forum.
